1. ABOUT KD FARMS

KD Farms is engaged in the production and delivery of farm-fresh dairy products sourced directly from its own farm and delivered to customers through a subscription-based and order-based model.

2. PRODUCTS & SERVICES

We offer perishable dairy products, including but not limited to:

• Milk
• Curd
• Paneer
• Butter
• Ghee
• Buttermilk / Lassi
• Shrikhand

Product availability may vary by location, season, and operational capacity.

3. SUBSCRIPTION & ORDER MODEL

• Certain products are available only via subscription.
• Subscription quantities, delivery frequency, and pause options are configurable through the Platform.
• Trial subscriptions are introductory in nature and do not guarantee long-term availability or pricing.
• KD Farms reserves the right to modify, suspend, or discontinue any subscription plan with prior notice.

4. PRICING & PAYMENTS

• All prices are displayed in Indian Rupees (INR) and are inclusive/exclusive of taxes as applicable.
• Payments are processed securely through Razorpay.
• KD Farms does not store your card, UPI, or banking information.
• Successful payment confirmation is mandatory for order acceptance.

5. DELIVERY POLICY

• Delivery timings are indicative and may vary due to weather, traffic, or operational constraints.
• Milk and dairy products are delivered fresh and intended for same-day consumption.
• KD Farms is not liable for delays caused by circumstances beyond reasonable control.
• Customers are responsible for ensuring availability at the delivery location.

6. QUALITY & CONSUMPTION DISCLAIMER

• Dairy products are natural and may show minor variations in taste, color, or texture.
• Customers with allergies, medical conditions, or dietary sensitivities should consult a professional before consumption.
• KD Farms does not make medicinal or therapeutic claims.

7. CANCELLATION, REFUND & SUBSCRIPTION POLICY

(IMPORTANT – PLEASE READ CAREFULLY)

a) Nature of Subscription Payments (Advance & Non-Refundable)

• All subscription payments made on the KD Farms Platform are advance payments.
• Since dairy products are perishable in nature and production & logistics are planned, subscription amounts once paid are strictly non-refundable.
• By subscribing, the customer agrees that no cash refund or bank refund shall be applicable under any circumstances, except as explicitly mentioned below.

b) Subscription Pause Policy (ALLOWED)

KD Farms allows temporary pauses as a customer-friendly option.

• Subscriptions can be paused before the cutoff time for the next delivery day.
• Paused days will be adjusted against future deliveries.
• No refund will be issued for paused days; only delivery extension is allowed.

Pause facility is subject to operational feasibility and must be requested through the Platform or customer support.

c) Subscription Cancellation Policy (NO REFUND)

• Customers may request cancellation of subscription, however: No refund (full or partial) will be issued for any unused or remaining subscription value.
• Any unused balance (if applicable) will be handled as per Wallet Rules (see Section 11).

Cancellation does not entitle the customer to any cash or bank refund.

d) Dispatch & Delivery Cutoff

• Once a product is dispatched for delivery, it cannot be cancelled, refunded, or replaced.
• KD Farms shall not be responsible for non-delivery due to: Customer unavailability, Incorrect address, or Refusal to accept delivery.

e) Quality Issues & Replacement (LIMITED CASES)

Replacement may be considered only if:

• Wrong product is delivered, OR
• Product is damaged at the time of delivery, OR
• A genuine quality issue is reported within 2 hours of delivery, along with supporting images/videos.

Replacement is subject to internal verification and approval by KD Farms. No cash refunds will be issued even in approved cases.

f) Trial Subscription Policy

• Trial subscriptions are introductory and non-refundable.
• Trial pricing, duration, and availability may change without prior notice.
• Trial completion does not guarantee continuation at the same price or terms.

g) Payment Failures & Technical Errors

• In case of duplicate payments or failed transactions: Refunds (if applicable) will be processed within 5–7 working days to the original payment source.
• KD Farms is not responsible for delays caused by banks or payment gateways.

8. USER RESPONSIBILITIES

You agree:

• To provide accurate and complete information
• Not to misuse the Platform or services
• Not to make false quality, refund, or delivery claims
• Not to attempt unauthorized access, hacking, or disruption

KD Farms reserves the right to suspend accounts for misuse or fraud.

9. LIMITATION OF LIABILITY

KD Farms shall not be liable for:

• Indirect or consequential damages
• Health outcomes unrelated to product quality
• Issues arising from improper storage or consumption

Maximum liability, if any, shall not exceed the value of the affected order.

10. INTELLECTUAL PROPERTY

All content; branding, logos, images, and materials belong to KD Farms and may not be used without written permission.

11. WALLET POLICY

a) KD Farms Wallet – General Rules

• KD Farms may maintain a non-cash wallet balance for customers for adjustments, goodwill credits, offers, or approved cases.
• Wallet balance: Cannot be withdrawn, Cannot be transferred, Cannot be encashed.

b) Usage of Wallet Balance

Wallet balance can be used only for: Future KD Farms product deliveries, Subscription adjustments, Promotional offers as defined by KD Farms.

Wallet balance has no cash value.

c) Wallet Expiry

• Wallet balance, if any, is valid for a limited period as communicated at the time of credit.
• Unused wallet balance may expire automatically after the validity period.
• KD Farms is not liable to remind customers before wallet expiry.

d) Wallet on Subscription Cancellation

• If a customer cancels a subscription: Any discretionary balance (if approved by KD Farms) may be credited to wallet. No refund to bank or cash will be issued.

12. CASHBACK & PROMOTIONAL OFFER POLICY

a) Nature of Cashback

• All cashback offered by KD Farms is: Promotional in nature, Credited to KD Farms Wallet only, Not real money or bank cashback.

b) Cashback Conditions

• Cashback is applicable only if: Subscription payment is successful, Customer meets all eligibility criteria, No violation of Terms & Conditions is observed.
• Cashback: Cannot be clubbed with other offers unless specified, Cannot be transferred or withdrawn, Can only be redeemed against future KD Farms purchases.

c) Cashback Reversal

KD Farms reserves the right to reverse cashback if: Subscription is cancelled, Order is refunded / replaced, Abuse or misuse of offers is detected, False claims or fraudulent activity is identified.

d) Offer Changes & Withdrawal

KD Farms reserves the right to: Modify, Suspend, Withdraw any cashback or promotional offer at any time without prior notice.

13. GOVERNING LAW

These Terms are governed by the laws of India. Courts of Surat, Gujarat shall have exclusive jurisdiction.
